Welcome to Superpower Resume ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website and services at superpowerresume.com and app.superpowerresume.com (the "Service"). By using the Service, you agree to these Terms.

If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use our Service. If you are between 13 and 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements and have the legal capacity to enter into this agreement.

2. Your Account

To use most features of the Service, you must create an account. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately at [email protected] if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Your Content

You may upload resumes, cover letters, job postings, career documents, professional references, headshot images, and other personal data ("Your Content"). You retain full ownership of Your Content.

By using the Service, you grant us a limited, non-exclusive license to use Your Content solely for the purpose of providing and improving the Service (e.g., generating resumes, storing drafts, creating document embeddings for search). We do not claim ownership over Your Content.

You are responsible for ensuring that Your Content is accurate, lawful, and does not infringe on the rights of any third party.

4. AI-Generated Content

Our Service uses artificial intelligence (AI) to help you create resumes, cover letters, interview preparation materials, and other career content. Important disclosures:

  • No guarantee of accuracy — AI-generated content may contain errors, inaccuracies, or content that does not perfectly represent your experience. You are solely responsible for reviewing, editing, and verifying all AI-generated content before using it professionally.
  • No employment guarantee — We do not guarantee that using our Service will result in job interviews, job offers, or any specific employment outcome.
  • AI provider processing — Your career data and job descriptions are processed by third-party AI providers (OpenAI, Google AI, Cloudflare Workers AI) to generate content. See our Privacy Policy for details.
  • Content ownership — You own the AI-generated content created through the Service. However, similar content may be generated for other users providing similar inputs.

5. Prohibited Conduct

You agree not to:

  • Use the Service to create fraudulent, misleading, or deceptive resumes or career documents
  • Attempt to manipulate, bypass, or inject malicious prompts into our AI systems
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers) to access the Service without written permission
  • Upload content that is illegal, hateful, defamatory, or harmful
  • Impersonate another person or misrepresent your affiliation with any entity
  • Use the Service for any purpose that violates applicable laws or regulations
  • Interfere with or disrupt the Service or its infrastructure
  • Share your account credentials or allow others to use your account
  • Exceed usage limits or circumvent rate limiting

6. Subscriptions, Payments, and Refunds

a. Pricing and Billing

Some features of the Service are available only through a paid subscription. By subscribing, you agree to pay the fees displayed at checkout. Pricing may change with 30 days' notice, but changes will not affect your current billing cycle.

b. Payment Processing

We use Stripe to process payments. By subscribing, you authorize us to charge your selected payment method on a recurring basis (monthly or annually). Your payment information is handled directly by Stripe and is never stored on our servers.

c. Refunds

We offer a 7-day refund policy. If you are unsatisfied with the Service, you may request a full refund within 7 days of your initial purchase or renewal by contacting us at [email protected]. Refund requests made after 7 days will be reviewed on a case-by-case basis. If you experience a technical issue or believe you were billed in error, contact us and we will work to resolve it.

d. Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation:

  • Your access to paid features remains active until the end of your current billing period
  • No partial refunds are provided for unused time in the current billing period
  • Your account and data are not deleted — you retain access to free-tier features

e. Free Trials

If we offer a free trial, you will receive access to paid features for the duration of the trial. You may cancel before the trial ends to avoid charges. If you do not cancel, your subscription will automatically begin and you will be charged at the displayed rate.

7. Intellectual Property

All software, code, branding, design, and content provided by Superpower Resume (excluding Your Content and AI-generated output) are our intellectual property or the property of our licensors. You may not copy, modify, distribute, or create derivative works based on our intellectual property without written permission.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service, other users, or third parties.

Upon termination:

  • Your right to access the Service immediately ceases
  • We may delete your account data after a reasonable period
  • You may request a copy of your data before deletion by contacting us
  • Provisions that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) will survive

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • AI-generated content will be accurate, complete, or suitable for any purpose
  • The Service will meet your specific requirements or expectations
  • Results obtained from the Service will be accurate or reliable

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SUPERPOWER RESUME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR EMPLOYMENT OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Superpower Resume from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from: (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any rights of a third party.

12. Dispute Resolution

Any disputes arising from these Terms or the Service will be governed by the laws of the State of Texas, without regard to conflict of law principles. You agree to resolve disputes through good-faith negotiation first. If unresolved, disputes will be settled by binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

13. Modifications

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.

14. Miscellaneous

  • Entire Agreement — These Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and us.
  • Severability — If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.
  • Waiver — Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
  • Assignment — You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
